The Little Fine Arts Library Essay - 1266 Words

The Lucille Little Fine Arts Library doesn’t seem like much from the outside. A relatively older building, it doesn’t catch the eye the way that William T. Young Library does, nor does it take center stage the way Young Library does. Nestled into a little cranny next to a side walk, Little Library can easily be missed if one isn’t paying much attention; despite that, however, the library is still a popular place to study on campus. Students of various disciplines, not just the fine arts, come to Little Library to study. What’s most interesting about the library is how it accommodates students who aren’t studying the fine arts while still acting as a study hub for people who do study the fine arts. Although Little Library contains resources fit mostly for fine arts majors, the library still manages to address many people’s need of a solitary study area. The library accomplishes this through its careful choice and placement of furniture and art work throughout the building. One aspect of the library that stuck out to me instantly was the distribution of seating. The first floor of the library has a large collection of relatively comfortable bright red chairs and several tables with dividers to give people privacy. I was born in Detroit, Mi. located in the United States of America in a middle to upper middle class family in the year in 1983 which would make me 30 this November 16th. I can only speak English at the moment but Im learning Spanish. I dont really have a religious belief, Im more of a spiritual person but Ill talk more about that later. Race-Black Being of the Black skin tone has been a very unique experience I most say, compared to other skin tones of the world. I say this because many ethnic groups have my same skin tone and even darker but they all have different worldviews. As a black male that grew up in a large black populated city I can definitely attest to having a true Black race culture running deep in my character. There is a person on the other side of the world that looks exactly like me but lives by different creed, might not have any respect for me because of the country I come form and the way I may carry myself. The fact that if you put the to of us in the same room together many would pass us as brothers when really we never even seen each other before in our lives. The term black may always be very interestingly broad. Ethnicity- African American Africans became Americans is one that shows man-kind its worst. Many would say they prefer not to be referred as Africans since they know nothing of their ancestries from over 400 years ago. This truth about people of color not claiming there heritage is very unsettling to me because where you come from can help in determining your future, whether its 5 years ago or 5 hundred years ago. Its is very important for us not to let the past be erased because us remember who we are at times when we may forget in this crazy life we live. Our history was erased in the purpose so that we were nothing before we were called slaves even though there monuments in Africa and over parts of the globe that show proof that we were once a very special people. Yet in movies and even reenactments of the times of black kings and queens the actors are always white or fake Egyptian looking mulattoes. But there could be a change coming since more studies are showing that the first man was black when they found the oldest human bones in Africa. Hopefully change is coming but it may be noticeable until the generation that my great grandchildren live in. Aside from the being the murder capital so many years, the experiences that I have learned growing up there cannot be compared to any other place on earth I feel. The biggest actor is that it is one of the only mostly black populate and mostly black run city in the America (not saying its done right) that was once thriving very well. Im not saying that I would have wanted to grow up in a big house in the suburbs but being raise with all types of strains of black people was very educating. At the moment my old neighborhood is at its worst. We never had a burned house on my block that didnt get fixed well 3-4 years ago it happened and that when you know your neighborhood is going down. I always saw illegal activity but it was mostly done in a certain manner ere if you didnt have an eye for it you would never notice. But with ever summer that passed the people got crazier; I noticed this when I turned 13. As soon as the as spring day would hit somebody would do something 10 times wilder, reckless, and deadlier then the last summer. Its like they were in competition with each other, but it really was Just a sign that things were getting worst. In the mist of all this was me pretty street smart because of it. Sex- Male Being a male growing up in Detroit, many would say I wasnt suppose to make it to see my twenty as many of my school never did, but I stand here blessed about to see 0 years of age. I am nothing but grateful for that because I personally know tooo many that could make it through 9th grade let alone through the twenties alive and not scorn too much by lifes trials and tribulations. I would never trade being the dominant of the sexes but as I am a wise man I know women rule the world. Detroit is a black city so thats the point of view I am most similar with, being that I have traveled a bit in my time I have much understanding of the views other males of different races and ethnicities. Class- Middle/Upper middle class I place myself in the middle to upper middle class because both my parents had uccessful business as I was growing up. My mother had a day care in our basement for 25years (until I was 15 years old), which had around 12 kids Monday- Friday. My Dad was an engineer for the board of education plus he did real estate amongst other things. I never experience lights going out or any bills not being paid in out house hold. We did go on trips in the summer but that was not the case for the rest of my surroundings. Some of my friends from back then still have never sit foot out side Detroit and dont plan on it even though the cities doing nothing but getting worst. Growing in this type of setting did make me grateful in most ways but at times it made me feel Just as poor as the other kids simply because they were my friend or that is who I saw every day, there problems were mine at times because of that. Funny thing is that this class is growing more and more in America. It makes me wonder whats to come of it, especially with a black president. Age-Young Adult To be a young adult it feels good and even better to be in college about to get a degree to make the family feel they did good and the bloodline shall thrive on. Sometimes its easy to forget how precious life is and how it can be taken away. At his time in my life I feel IVe so much and understand even more but there some much more the world has to offer me. At 30 1 understand the mistakes the late teens and twenty something year old people make and I can laugh to myself and say I did that one time or sometime because I believe I have always been a little ahead of my time I say I would have never did nothing like that. I guess being a young adult all I can do is feel blessed and know there is a reason for my existence. What that is Guess I have to keep on living to find out. Language- English At the moment I speak English but I have been in multiple French class in lementary school that I have forgotten and I am currently in a Spanish 2 class even though I dont remember what I learned in Spanish-I two to three semester ago. I know learning it will help me when I move to California next summer but I can never impacted me negatively in anyway but I know moving to California where Latinos dominant, Spanish will be more then need if I want to be able to do business with everybody. When I geta chance to tell a kid 12-18 years old something I keep it direct and raw. Just as it was passed to me through the years. Sugar coating truth of life is the worst thing we can to do when passing on our knowledge because life is not sugar coated like in the movies. This is the perception most people have in one way or another and t is hurt them a little bit more as time goes on. I tell kids that there is nothing greater then you because there is only one you and never will be another. Following information to be given to correspondents:- name of the vessel, date of the incident ,place of the incident , cargo particulars, quantity of damaged cargo, amount of the damage, location of cargo, bill of lading no, loading port, loaded quantity ,cause of the damage, contact details of the agent ETA/ETD of the vessel (PICLUBJAPAN, n.d.) Try to control further damage by taking all possible measures for lessening of damage unless such would involve a risk to the vessels safety (PICLUBJAPAN, n.d.) Take photos of the damaged cargo and the suspected causes (PICLUBJAPAN, n.d.) Log book entries like, sea conditions, weather and wind force (PICLUBJAPAN, n.d.) Sea protest should be filed at next calling port, if the damage was caused by bad weather (PICLUBJAPAN, n.d.) Employment ActFor employees covered by the Employment Act, employment disputes will only be referred to the Labour Court for adjudication if they are unable to be resolved amicably through conciliation. Conciliation is a process which involves negotiations between the parties, then coming up with a mutually agreed decision that is fair to the parties involved. However, certain conditions must be satisfied, that the claim must be on matters arising not earlier than one year from the date of lodging the claim, and if the employee concerned had already left employment, the claim must be lodged within six months from the date of leaving employment.For managers and executives who are not covered by the Employment Act, the Ministry will consider providing mediation service to help resolve employment disputes on breach of contract or retrenchment. Mediation, a non-adversarial process, involves a mediator who will facilitate the entire process by helping the parties involved to first identify issues, negotiate, then find a practical solution and settlement that all parties involved are mutually agreeable to and able to accept. The mediation process is voluntary and considered on a case-by-case basis.There are certain requirements that will apply, which includes that the managers and executives are earning $4500 and below, the claim is in respect of a matter which occurred within the period of one year before the date that the issue is reported, if the claim is for items related to their termination (e. g. notice, the issue must be lodged within six months from the date on which the employee has left employment), and when viable alternatives such as private amicable settlement with employer had been exhausted.However, if either party fails to respond to mediation or if no amicable settlement could be reached after mediation, the matter will then be pursued in the civil court. d. Industrial Relations Act The Industrial Relations Act is passed in 1960 to provide a mean to settle employment disputes through collective bargaining which involves the union, conciliation and if unresolved, through arbitration held by the Industrial Arbitration court. This act aims to protect employees who are members of the union, allowing them to enjoy benefits covered under.Examples of union include the Food, Drinks and Allied Workers Union and Singapore Airlines Staff Union. This act limits the representation of employees who are in managerial and executive positions in certain areas. As defined in Section 30(1) of Industrial Relations Act, an executive employee is an employee who is employed in a managerial or executive position. They are not allowed to have representatives from the union to negotiate for retrenchment benefits upon retrenchment or resolving any dispute in the contract of employment.As this act is a bridge to the tripartite relationship in Singa pore, namely the government, employer and employee, there are certain procedures to follow in accordance to filing a case against the employer in a unionized organization. Preceding the filing, the employee would have to try to resolve the dispute with his immediate supervisor. Failing that, he or she can choose to bring the matter up to a member of the branch committee of the Union who would make a representation of the employee in resolving the dispute.In more serious cases, it can be brought up to the Human Resource Department by the General Secretary of Union and may even request a union management meeting with the management of the company. After all means, both parties will then refer the case to Ministry of Manpower for conciliation which is an invitation to negotiate under the Act. If an agreement is not reached by both parties, they can seek mediation by the Industrial Arbitration Court. 4. Different Courts The employees covered under the different acts will bring up their unresolved disputes to different courts. . Labour Court The Labour Court, deals with issues between employers and employees when they cannot be resolved through mediation or reconciliation at the MOM level. It is empowered by law to inquire into and arbitrate disputes between employees and employers. If mediation between the parties does not yield any agreement, for example, company not paying their employee salary or wrongful dismissal. The decisions or orders by the Labour Court are enforceable. It is also more viable for the employee to go through the Labour Court to settle employment disputes.However, the employees must not be earning more than S$2500 per month and are covered under the Employment Act. In the case of Vertex Global Holdings Pte Ltd, they owed an employee in arrears for about 2. 5 months. They gave the reason of having financial difficulties and were not able to pay the employee. The case was brought up to the Labour Court but they did not accept this explanation and the company was ordered to pay the employee amounting to $2820. In another case whereby a cook employed by VP Food Pte Ltd, he was terminated after 3 days.However, the employer was to pay him a sum of $235. 38 for work done but was underpaid. The reason that the employer gave was the distress caused by the cook’s harassment and there was no notice period specified. The explanation was rejected. The court held that Employment Act prevails and notice pay was payable In such cases, Labour Court comes into good use when dealing with unfair treatment from the company. But in recent years, the number of cases being brought up to Labour Court has decreased from 2009 to 2010.This shows that mediation or reconciliation has contributed to a huge part of the decrease in number of cases and they would be a better solution to problems than going to court. f. Industrial Arbitration Court Employment disputes, concerning union members, are not resolve under the conciliation of MOM are re ferred to the Singapore Industrial Arbitration Court (IAC) for further remediation. The IAC resolve disputes between employers and employees by offering the best possible solutions that are not only fair and beneficial to both parties but also in the interest of the community and country’s economic situation.The decision made by the Justice of IAC is concluding hence it cannot be disputed or appealed against. Voluntary and compulsory arbitration are the two ways that employers, unions or the government can refer an employment disputes to the IAC. Through the voluntary arbitration, employers and unions can refer their cases to the IAC through a joint or ex-parte application however this is only applicable when mediation at the MOM level is deem inconclusive. Under compulsory arbitration, a dispute is referred to the IAC when it is directed by the MOM or the President of Singapore.With increasing efforts from tripartite co-operation, Singapore has seen a great decrease in the n umber of cases being handled at IAC. The number of employment dispute cases averaged 10 per year and this indicate that that majority of the cases are being resolved at MOM and union level. This is essential as it helps to reduce unnecessary loss of work man hours and provide foreign investor’s confidence to invest in Singapore which in turn boosts the Singapore economy. Over the years, IAC has proven to be an effective way in solving disputes between employees and employers however there are cases when one party might feel otherwise.In the case of the dispute between Singapore Refinery Company and the representing union, the general secretary of SRCEU mentioned that â€Å"the union is disappointed with the ruling as a whole. † The case was brought up to the IAC for settlement as the union demanded salary and service increment for SRC employees. The president of IAC concluded that SRC will increase the service increment to 5 per cent plus $15 and 3 per cent salary incr ement. The union felt that the increment was too low and there was no effective communication between them and the company.This case show that whiles the IAC may provide the best feasible solution however it does not mean that it is the best fit for all the parties involved in the dispute. g. Civil Court The role of civil courts in resolving employment disputes is at minimal. Disputes raised by Professionals, Manager and Executives, also known as the PMEs, earning up to S$4,500, are solved in civil court. However, the Ministry of Manpower in Singapore is looking into resolving their salary disputes in Labour Court in the near future, limiting it to S$20,000.This allows PMEs to seek a lower cost alternative in resolving their disputes. For breaches in employment contract, it will still be handled by civil courts under law of contract. 5. Comparison h. In Singapore, employees covered under different acts are represented by different people such as the union leader or even unrepresented in front of the labour court. The different courts are designed to different cases involving money or other disputes while all disputes in United States are brought to only one court. 6. Conclusion Through intensive research and findings, this report covers the key points on how the different courts resolve employment disputes.Although MOM have proven to be an effective medium in mediating disputes between employers and employees, there is still a need for the presence of court to re solve cases that are more complex. Case studies are being brought up in the report to further illustrate how disputes are being resolved at different levels. In referring to the SRC case, it clearly highlight that although the IAC has provided the best possible remedy however it does not satisfy all parties who are involved in the case.This means that better procedures can be considered to better understand the problems underlying between employees and employers. Through our recommendations, it will provide possible solution to further enhance the system that is already in place. A walk-through test that is used during an audit shows the path a transaction takes through the accounting system from start to finish to get an understanding for how reliable the company’s accounting system is. According to PCAOB Auditing Standard No. 2 Appendix E Number 57, performing â€Å"walkthroughs† are not optional under the standard’s directions. 5. One audit procedure that could have helped Grant Thornton discover fraud with JGI’s delivery receipts would have been confirmation. If Thornton’s associates called all the vendors that sold JGI inventory on their prepaid inventory list and asked if the inventory had been delivered yet, they would have found out that some of the inventory in the prepaid inventory account was also in merchandise inventory account. Another procedure that could have helped catch the fraud would be inspecting internal and external documents and comparing them to each other. 6. Once an audit firm informs client management of important internal control weaknesses, I don’t believe the audit firm has a responsibility to insist that client management correct the problems unless it is preventing the auditor from getting the necessary information needed to perform the audit.
